Terms & Conditions of Sale
1. Definitions
“Company” means CIBCO (Channel Island Bed Company).
“Customer” means the person, company or organisation purchasing goods or services from the Company.
“Goods” means all beds, mattresses, furniture, flooring, care equipment and associated products supplied.
“Services” includes delivery, installation, specification advice and project coordination.
2. Quotations
2.1 All quotations are valid for 30 days unless otherwise stated.
2.2 Prices are based on specifications provided at the time of quotation.
2.3 The Company reserves the right to amend pricing where supplier costs, freight, exchange rates, or specifications change prior to order confirmation.
3. Orders
3.1 Orders are only binding once confirmed in writing by the Company.
3.2 Any variation requested after order confirmation may result in additional charges and revised delivery times.
3.3 Bespoke, made-to-order, upholstered or custom-manufactured goods cannot be cancelled once production has commenced.
4. Pricing & Payment
4.1 Prices are exclusive of VAT where applicable.
4.2 Unless otherwise agreed in writing:
• A deposit of up to 50% may be required on order confirmation.
• The balance is payable within 7 days of delivery or installation.
4.3 The Company reserves the right to charge interest on overdue accounts at 4% above base rate.
4.4 The Company may suspend further deliveries where payment terms are not met.
5. Delivery
5.1 Delivery dates are estimates only and are not guaranteed.
5.2 The Company shall not be liable for delays caused by manufacturers, shipping schedules, freight providers, weather conditions, customs processes, or circumstances beyond reasonable control.
5.3 Risk transfers to the Customer upon delivery to site.
6. Installation
6.1 Where installation services are provided, the Customer must ensure:
• Clear and safe access
• Premises prepared and ready
• Adequate lighting and utilities where required
6.2 Additional charges may apply where installation is delayed due to site readiness or access issues.
7. Retention of Title
7.1 All goods remain the property of CIBCO until payment has been received in full.
7.2 The Company reserves the right to recover unpaid goods where invoices remain outstanding.
8. Inspection & Acceptance
8.1 The Customer must inspect goods upon delivery.
8.2 Any damage, shortages or discrepancies must be reported within 48 hours.
8.3 Goods shall be deemed accepted after installation unless defects are reported within this period.
9. Returns & Cancellations
9.1 Standard stock items may only be returned with prior written agreement.
9.2 Bespoke, custom-made or upholstered goods are non-returnable unless faulty.
9.3 Approved returns may be subject to handling or restocking charges.
10. Warranty
10.1 Manufacturer warranties apply where relevant.
10.2 Warranty does not cover:
• Normal wear and tear
• Improper use or misuse
• Damage caused by third-party installation or modification
• Commercial overuse beyond intended specification
10.3 The Company will assist in facilitating warranty claims but is not responsible for manufacturer decisions.
11. Limitation of Liability
11.1 The Company’s liability shall be limited to repair, replacement or refund of defective goods.
11.2 The Company shall not be liable for indirect or consequential losses including loss of revenue, loss of occupancy, operational disruption or business interruption.
12. Force Majeure
The Company shall not be liable for delay or failure to perform obligations due to events beyond reasonable control including but not limited to supplier delays, shipping disruption, labour shortages or natural events.
13. Governing Law
These Terms & Conditions shall be governed by the laws of Guernsey and subject to the jurisdiction of the Guernsey courts.
